An overview of New Jersey’s Code Requirements for Electrical Safety and Infrared Testing: NFPA 70B

In a significant move to enhance the safety, efficiency, and longevity of its commercial industrial, institutional and large residential buildings, NJ instituted a code requirement outlined in the NFPA 70B, which includes mandatory infrared testing as part of its electrical safety and maintenance recommendations. 

In 2023, NFPA 70B* mandated annual inspections for ALL electrical equipment, with thermographic inspections and reporting every six months for equipment needing urgent actions identified in prior scans and other specified situations. The mandate also requires that inspections and reporting be done by qualified personnel. 

Infrared thermography is a testing method that uses thermal imaging to detect anomalies and deficiencies that are not visible to the naked eye. These anomalies often indicate underlying issues such as moisture intrusion, electrical faults, insulation gaps, and structural defects. By identifying these problems early, property owners and managers can take corrective actions before they escalate into hazardous conditions or costly repairs. This advanced technology has become vital in safeguarding many built environments and in optimizing operational performance.

Key aspects of the code requirement stipulates that all buildings undergo infrared testing at several critical stages: Pre-construction Assessment, Post-construction Inspection, and Routine Maintenance Checks

To ensure compliance with the new code, New Jersey has outlined protocols for conducting infrared testing which include:

Certification of Inspectors: Only certified infrared thermographers are authorized to perform the inspections. This guarantees that the testing is conducted by professionals with the necessary expertise and experience.

Documentation and Reporting: Detailed reports of the infrared inspections must be submitted to the relevant state authorities. These reports should include thermal images, analysis of findings, and recommendations for any necessary remedial actions.

Follow-up Actions: In cases where anomalies are detected, property owners are required to address the issues within a specified timeframe and undergo re-inspection to confirm that the problems have been resolved.

This comprehensive approach should be applied at the most optimal times. For instance, testing air conditioning and refrigeration systems is most effective during the warmest months. In plants and manufacturing facilities, testing is best conducted during full production days. Conversely, data centers, warehouses, office buildings and retail can be tested any time of the year.

Inspection of your electrical equipment is required at least every 12 months to prevent electrical equipment failures that could result in hazards such as fires, explosions, or electric shock.  Early detection of potential issues can significantly reduce costs associated with major repairs and operational interruptions later. Cannabis Facility Security in NJ

Cannabis is a developing industry in NJ and one that will generate a huge amount of revenue. Of course, you’ll need to protect your business from theft, damage, and loss but you must also be in strict compliance with NJ state code for cannabis facility security. NJ Code (17:30-9.10*) requires every cannabis business to have a full security plan in place whether it be for a growing facility, a retail site or warehouse.

Access Control Security is at the top of the list. An Access system provides control over who can enter the facility or areas within it. Storage of the product must also be under restricted access. Only with assigned proper credentials via a key card can an individual enter an area, whether interior or exterior.

Another important security piece is Video Surveillance. As a cannabis business owner in NJ, state code requires your operation to be under 24 hour video surveillance with certified 24 hour monitoring. Installing high quality cameras with good sound and monitoring is the best way to adhere to regulations while also preventing theft. Integrating your access control and camera system will provide additional compliance and safety along with remote access logs and visual reporting for your record keeping.

Monitoring doesn’t stop at theft prevention. Environmental monitoring is key in growing facilities. You want to keep many factors balanced, like temperature, PH levels, humidity and CO2 levels. Section 17:30-9.10 – Security

(a) Each cannabis business shall provide effective controls and procedures to guard against unauthorized access to the premises or the business’s electronic systems, theft, and diversion of cannabis. Such controls may include, but are not limited to, systems to protect against electronic records tampering.

(b) At a minimum, each cannabis business shall:

1. Install, maintain in good working order, and operate a safety and security alarm system at its premises that will provide suitable protection against theft and diversion and that provides, at a minimum:

i. Immediate automatic or electronic notification to alert cannabis business personnel and State or local police agencies to an unauthorized breach of security or an alarm or system failure at the cannabis business; and

ii. A backup system that activates immediately and automatically upon a loss of electrical support and that immediately issues either automatic or electronic notification to State or local police agencies of the loss of electrical support;

2. Implement appropriate security and safety measures to deter and prevent the unauthorized entrance into areas containing cannabis and the theft of cannabis;

3. Implement security measures that protect the premises, consumers, and cannabis business personnel;

4. Establish a protocol for testing and maintenance of the security alarm system;

5. Conduct maintenance inspections and tests of the security alarm system at the cannabis business’s authorized location at intervals not to exceed 30 days from the previous inspection and test and promptly implement all necessary repairs to ensure the proper operation of the alarm system;

6. In the event of a failure of the security alarm system due to a loss of electrical support or mechanical malfunction that is expected to last longer than eight hours:

i. Notify the Commission pursuant to N.J.A.C. 17:30-9.11; and

ii. Provide alternative security measures approved by the Commission or close the authorized physical addresses impacted by the failure or malfunction until the security alarm system is restored to full operation;

7. Keep access from outside the premises to a minimum and ensure that access is well controlled;

8. Limit entry into areas where cannabis is held to authorized personnel; and

9. Equip interior and exterior premises with electronic monitoring, video cameras, and panic buttons.

i. A video surveillance system shall be installed and operated to clearly monitor all critical control activities of the cannabis business and shall be in working order and operating at all times. The cannabis business shall provide access for remote viewing by the Commission. This system shall be approved by the Commission prior to license issuance.

ii. The original tapes or digital pictures produced by this system shall be stored in a safe place with a 30-day archive;

10. Keep the outside areas of the premises and its perimeter well-lighted.

i. Exterior lighting must be sufficient to deter nuisance and criminal activity and facilitate surveillance and must make reasonable efforts to not disturb surrounding businesses or neighbors; and

ii. The video surveillance system shall be supported by adequate security lighting, which shall illuminate all entrances and exits, and which may be modified, as necessary, to include motion control sensors to protect cultivation light-dark cycles, as applicable; and

11. Provide law enforcement and neighbors within 100 feet of the cannabis business with

the name and phone number of a staff member to notify during and after operating hours to whom they can report problems with the establishment.

(c) The security alarm system and video surveillance system pursuant to (b) above shall be continuously monitored, 24 hours a day, seven days a week.

1. Monitoring of the security alarm system and video surveillance system may be conducted off-site.

Electric Vehicle Charging Station Program

NJ has a new program that benefits all business owners and property managers. “It Pay$ to Plug In” provides grants to offset the cost of purchasing electric vehicle charging stations. The program is designed to expand New Jersey’s growing network of electric vehicle infrastructure, allowing residents, businesses, and government agencies to purchase and drive electric vehicles. EVs dramatically reduce vehicle emissions and improve air quality for everyone!

It’s easy to apply for a grant.

Here are the steps as outlined on www.nj.gov -Obtain three (3) quotes for the EV charging stations. -Submit all required documents via the SAGE portal. -If the grant application is approved, NJDEP will provide and execute a grant agreement with the applicant via the SAGE portal. -Install Level 1 and Level 2 charging station(s) within 9 months of NJDEP grant execution. -Complete and submit the Expenditure Report and the Charger Information Form via SAGE along with paid invoices, proof of payment, and photos. -After NJDEP review and approval of provided invoices, grant funds will be disbursed.

Eligible locations include public parking lots and garages, apartments and condominiums, workplaces, hotels, retail, downtown areas, rest stops, and more. These grants can be combined with utility incentives for installation of charging stations.

Additionally, New Jersey has a tax exemption for electric vehicles. Zero Emission Vehicles are exempt from the NJ state sales tax, so you’ll save 6.625% on the sale, lease or rental of a new or used battery electric vehicle (also known as an all-electric vehicle) in weight classes 1-8. This exemption does not apply to plug-in hybrid electric vehicles. There is no restrictive language for personal or business use, as long as the vehicle is purchased and registered in the State. Emergency Radio Coverage Building Codes in New Jersey

Whether you own or manage a private or public building, new International Fire Code (IFC) requires an additional crucial protection in their building security. Emergency responders depend on reliable two-way communications during an emergency; however, many large buildings have reduced signal strength because of things like underground structures or specific building materials. 100% radio coverage is critical to manage any emergency.

The IFC states, “All new buildings shall have approved radio coverage for emergency responders within the building based upon the existing coverage levels of the public safety communication systems of the jurisdiction at the exterior of the building..” This pertains to buildings constructed after 2015. And the NFPA 72 Section 24.5.2 (2013 Edition) states that radio coverage shall be provided with 99 percent floor area coverage in critical areas and 90 percent floor area radio coverage in general building areas. www.nfpa.org

Emergency responder radio communications signal boosters are a code-required part of life safety systems which must be regularly maintained and inspected. These requirements are determined by building size, new construction, existing buildings and renovations. A few highlights to be aware of per the IFC code are as follows for new or existing buildings: (read the full IFC code here)

Sections 510 & 1103 510.1 Emergency Responder Radio Coverage in New Buildings

· All new buildings shall have approved radio coverage for emergency responders within the building based upon the existing coverage levels of the public safety communication systems of the jurisdiction at the exterior of the building. This section shall not require improvement of the existing public safety communication systems.

· Exceptions:

1. Where approved by the building official and the fire code official, a wired communication system in accordance with Section 907.2.13.2 shall be permitted to be installed or maintained instead of an approved radio coverage system.

2. Where it is determined by the fire code official that the radio coverage system is not needed.

3. In facilities where emergency responder radio coverage is required and such systems, components or equipment required could have a negative impact on the normal operations of that facility, the fire code official shall have the authority to accept an automatically activated emergency responder radio coverage system.

510.4.2.4 Signal Booster Requirements

· If used, signal boosters shall meet the following requirements:

1. All signal booster components shall be contained in a National Electrical Manufacturer’s Association (NEMA) 4-type waterproof cabinet.

2. Battery systems used for the emergency power source shall be contained in a NEMA 4-type waterproof cabinet.

3. The signal booster system and battery system shall be electrically supervised and monitored by a supervisory service, or when approved by the fire code official, shall sound an audible signal at a constantly attended location.

4. Equipment shall have FCC certification prior to installation.

510.2 Emergency Responder Radio Coverage in Existing Buildings

· Existing buildings shall be provided with approved radio coverage for emergency responders as required in Chapter 11.

510.5.4 FCC Compliance

· The emergency responder radio coverage system installation and components shall also comply with all applicable federal regulations including, but not limited to, FCC 47 CFR Part 90.219.

1103.2 Emergency Responder Radio Coverage in Existing Buildings

· Existing buildings that do not have approved radio coverage for emergency responders within the building, based upon the existing coverage levels of the public safety communication systems of the jurisdiction at the exterior of the building, shall be equipped with such coverage according to one of the following:

1. Where an existing wired communication system cannot be repaired or is being replaced, or where not approved in accordance with Section 510.1, Exception 1.

2. Within a time frame established by the adopting authority.

Fire Alarm Installation for NJ Windowless Basement Law

The “Windowless Basement Law” is currently being strictly enforced in New Jersey cities. Depending on the size of your windowless basement there are two fire suppression options to be aware of.

If your space is under 3,000 sq. ft: “Windowless basements not exceeding 3,000 square feet in area shall be exempt from this automatic suppression requirement, provided a supervised automatic fire alarm system shall be installed in accordance with the New Jersey Uniform Construction Code.”

If your space is between 3,001 – 10,000 sq. ft: “In windowless basements greater than 3,000 square feet, but not exceeding 10,000 square feet in area, the required suppression system need not be connected to a water supply other than an existing domestic supply if the following conditions are met: i. The suppression system shall be provided with a fire department connection, which shall be marked with a sign reading ‘Basement Area Sprinkler Water Supply;’ and ii. A supervised automatic fire alarm system shall be installed in accordance with the New Jersey Uniform Construction Code.”

According to NJ Division of Fire Safety Bulletin, The Windowless Basement Law intends to protect not only occupants but specifically fire fighters with the requirement of early fire detection, suppression and a fire alarm sounding system. As an alternative to a fire service water supply or suppression system, the provision allows for the installation of an automatic fire alarm system where there is “early fire detection and an immediate notification of the fire department” to satisfy the requirement.

Automatic Fire Alarm System installations must adhere to the New Jersey Uniform Construction Code and installed and supervised by standards specified by the UCC.
